5-Hour Energy Sued Over Advertising Claims

Oregon, Washington, and Vermont have sued the makers of 5-Hour Energy drinks for deceptive and misleading advertising. The states are seeking an injunction, penalties, and restitution. 5-Hour Energy, a popular energy drink, claims that its stimulant-like effects are due to a unique combination of ingredients. However, according to Oregon's lawsuit, a concentrated dose of caffeine is the only active ingredient. 5-Hour Energy also advertises that its formula will not cause consumers to “crash” from a caffeine high—another allegedly misleading claim. Private consumers have also filed suit against 5-Hour Energy’s parent companies, and more states are expected to file as well.
